  1. Introduction

 

Welcome to Peak Gym!

 

This Membership Agreement and Terms & Conditions (“Agreement”) govern access to and use of Peak Gym facilities, services, classes, and programs. By agreeing, I confirm that I understand and accept all terms outlined in this Agreement.

 

 

  1. Membership Eligibility
  • Members must be 21 years or older.
  • A valid government-issued photo ID is required upon registration to verify age and identity.
  • Peak Gym reserves the right to suspend or terminate any membership or deny access to the facility at any time, with or without cause, and without prior notice or refund, at its sole discretion.
    • All memberships are non-transferable and non-refundable.

 

 

  1. Membership Types, Registration Fee & Payment Terms
  • Membership options include monthly, annual, prepaid, or corporate plans as outlined online or at reception.
  • A one-time registration fee applies upon joining unless waived by a special promotion.
  • Members rejoining after 4 months of inactivity must create a new account and pay any applicable registration fees.
  • Membership fees are due in advance and are non-refundable.
  • Recurring memberships renew automatically on the billing date unless cancelled.
  • Authorization is given for Peak Gym to charge the chosen payment method for all dues and agreed charges.
  • Sufficient funds must be maintained; declined payments may result in suspended access.
  • Unpaid balances may be sent to collections if unresolved after notice.

 

Corporate Memberships

  • Members with corporate rates may cancel at any time by ending their payment authorization.
  • Rejoining at a corporate rate after cancellation may require a new registration fee.

 

 

  1. Membership Cancellation, Renewal & Rejoining
  • Pay-as-you-go memberships end automatically when the paid period expires; no action is required.
  • Recurring subscriptions may be cancelled at any time by ending payment authorization. No notice is required.
  • No refunds are provided for unused time or fees already paid.
  • Once cancelled, recurring memberships will not renew, and access ends at the conclusion of the current paid period.
  • Inactive Membership Data Policy: Personal data of members inactive for 4 months or more will be permanently deleted. Returning members must re-register and pay applicable registration fees.

 

 

  1. Facility Access & Hours
  • Members must check in using the designated access method, which may include membership ID, app, barcode, QR code, fingerprint, facial recognition, or any other system implemented by Peak Gym.
  • Access is permitted only during posted hours.
  • Temporary closures for maintenance, repairs, holidays, or events may occur; notice will be provided when possible.
  • Last entry is permitted one hour before closing, with all members required to exit at least 10 minutes before closing.
  • Peak Gym may modify or upgrade access methods at any time without prior notice.

 

 

  1. Waiver of Liability & Assumption of Risk

By agreeing to this Agreement:

  1. I understand participation in exercise activities involves inherent risks, including injury, illness, disability, or death.
  2. I voluntarily assume all risks associated with use of Peak Gym facilities, equipment, and programs.
  3. I release, waive, and discharge Peak Gym, LLC, its owners, employees, trainers, contractors, and affiliates from all claims, demands, or liability arising from participation, including negligence.
  4. I agree to indemnify and hold harmless Peak Gym from all losses, damages, costs, or attorney fees arising from my actions or violation of this Agreement.
  5. I certify I am physically fit for participation and will obtain medical clearance if uncertain.
  6. Peak Gym is not responsible for lost, stolen, or damaged property.
  7. This waiver applies to all on-site and off-site events, programs, or activities organized, sponsored, or permitted by Peak Gym.

 

 

  1. Rules of Conduct & Etiquette
  • Treat all members and staff courteously.
  • No harassment, discrimination, profanity, or aggressive behavior.
  • Re-rack weights and clean equipment after use.
  • No dropping or slamming weights.
  • Personal training for profit by non-staff is prohibited.
  • Phone calls, filming, and loud conversations must not disturb others.
  • Violation of conduct rules may result in suspension or termination without refund.

 

 

  1. Safety & Hygiene
  • Use equipment responsibly and follow staff instructions.
  • Proper workout attire and footwear are required.
  • Wipe equipment after use and maintain hygiene.
  • No smoking, vaping, alcohol, or illegal drugs on premises.
  • Do not train under the influence of alcohol or controlled substances.
  • Report injuries or hazards immediately.
  • Participation is at the member’s own risk.

 

  1. Classes, PT Sessions & Booking Policy
  • Classes and PT sessions must be booked via app, website, or reception.
  • Cancellation Policy:
    • Classes: Minimum 3 hours’ notice (by closing time the day before for early/weekend sessions).
    • PT sessions: Minimum 24 hours’ notice.
  • Late cancellations or no-shows may incur full charges or loss of session credit.
  • Peak Gym may cancel or reschedule classes when attendance is low (3 or fewer).
  • Instructors and schedules may change without prior notice.

 

 

  1. Lockers & Personal Items
  • Lockers are for day use unless rented monthly.
  • Overnight storage is prohibited; items left overnight may be removed at owner’s risk.
  • Peak Gym is not responsible for lost or stolen belongings.
  • Locker rentals (if available) can be arranged at the front desk.

 

 

  1. Privacy Policy & Data Management

Peak Gym respects privacy and complies with U.S. data protection standards.

  • Personal data collected (e.g., name, contact info, payment details and photos) is used to manage memberships, communicate updates, schedule classes, and ensure safety.
  • Peak Gym does NOT request or collect any medical information.
  • Data may be shared with trusted third-party service providers under strict confidentiality agreements.
  • Personal information will not be sold.
  • CCTV may be used for safety; recordings (if cameras are installed) are retained up to 14 days. Consent is implied by entering the gym.

 

Data Deletion & User Rights

  • Members may delete their profile and data at any time through their account.
  • Members inactive for 4 months will have all personal data permanently deleted.
  • Requests for data access, correction, or deletion can be submitted at info@peakgymlv.com
  • Peak Gym may retain data as required by law or for accounting, tax, or legal purposes even after deletion.

 

 

  1. Photo & Video Release
  • By entering Peak Gym, members grant Peak Gym permission to use their likeness in photos or videos taken on-site for promotional, educational, or marketing purposes, without compensation.
  • Members waive the right to inspect or approve materials where their likeness appears.
  • All media remains the property of Peak Gym.

 

 

  1. Guests
  • Guest passes may be purchased at reception or online.
  • Guests must sign a waiver and Terms & Conditions prior to using the facilities.
  • Members are responsible for their guests’ conduct and safety.

 

  1. Studio Use Policy
  • Members may use the studio when not in use for classes, with staff permission.
  • Areas and equipment must be used safely and left clean.
  • Any damage will be charged to the responsible member.

 

 

  1. Refund Policy
  • All payments (memberships, PT sessions, classes, products) are final and non-refundable. No refunds will be issued in the event of voluntary cancellation, suspension, or termination of membership by Peak Gym for any reason.
  • Refunds are not provided for missed sessions, early cancellations, or disciplinary terminations.
  • Duplicate charges or proven billing errors will be refunded within 10 business days.

 

 

  1. Amendments
  • Peak Gym may modify or update these Terms & Conditions at any time.
  • Revised terms will be posted online and at reception. Continued use constitutes acceptance.

 

 

  1. Governing Law & Dispute Resolution
  • This Agreement is governed by Nevada law.
  • Disputes will be resolved exclusively in Clark County, Nevada courts.
  • If any part of this Agreement is invalid, remaining provisions remain enforceable.

 

 

  1. Acknowledgment & Signature

By signing below or checking the acknowledgment box online, I confirm that:

  • I have read, understood, and voluntarily agree to the Peak Gym Membership Agreement & Terms and Conditions.
  • I acknowledge the waiver of liability and accept all associated risks.
  • I have had the opportunity to ask questions and understand the Agreement fully.
  • I authorize Peak Gym to process membership fees according to my chosen plan.
